Episode 81 features Kirstie Donnelly, an Associate Solicitor with TC Young giving advice for landlords and letting agents on correct procedures to follow for certain unresolved issues with tenants.
Kirstie initially talks about the history of TC Young, the company’s dedicated Private Rented Sector team, their experience and the services that they provide.
Lets Talk host, Gillian Semmler, asks Kirstie about the First-tier Tribunal (formed to deal with concerns regarding rent or repair issues in private sector housing); its purpose, powers and procedure.
Kirstie and Gillian also cover the issue of tenants and anti-social behaviour (ASB) including the behaviours that fall within this classification, what action landlords should take and the consequences if they fail to do so. Kirsty discusses a previous case where such a scenario took place.
Incorrectly evicting a tenant
The Associate Solicitor at TC Young has extensive knowledge and experience handling cases of Wrongful Termination Orders (WTO), where landlords have failed to adhere to the proper eviction procedure or have served tenants with insufficient Notice to Leave. Kirstie shares examples of cases where this has occurred, her advice to landlords and also covers the issue when a landlord’s circumstances have genuinely changed after a tenant has been evicted and moved out.
At the end of the interview, Gillian chats to Kirstie about her vocation choice and what path she may have followed if she hadn’t pursued her legal career.
